Contractor Account Terms
The full terms that apply to a Merit contractor account. Written to be read, not to be skipped.
Last reviewed: 7 September 2026. These terms apply to rentals placed under an approved contractor account. Homeowner and one-off rentals are covered by our standard rental rules.
1. Scope
These terms govern contractor accounts with Merit Dumpster Rentals and apply to every rental placed under an approved account. They supplement our standard rental terms and, where the two conflict, these terms apply. “Account Holder” means the business approved for a contractor account. “Container” means any roll-off provided by Merit.
2. Eligibility and approval
Accounts are available to businesses with a valid EIN operating in El Paso or Teller County. Approval requires a completed account form, a valid payment method on file and acceptance of these terms. There is no credit check and no personal guarantee. Merit may decline or close any account at its discretion.
3. Rates
Account Holders pay Merit’s standard published rates. There is no trade rate, volume tier or account discount. Rates are published on the pricing page and may change with 30 days’ written notice to the email on file.
No rate is quoted differently depending on who is asking. Where a job falls outside the standard service — oversized loads, dense material, several containers at once, or delivery beyond the standard area — it is quoted before the container is dispatched.
4. What each rental includes
- One Container, 15 or 20 cubic yards as ordered
- Delivery and removal within the standard service area
- The rental period as ordered, beginning on the delivery date
- Disposal of up to 2 tons of accepted material
5. Scheduling
Same-day delivery is often available and most orders are delivered within 24 hours, but same-day service is not guaranteed. Where Merit cannot meet a requested date, the Account Holder is told at the time of the order and given the earliest date Merit can meet.
Where Merit confirms a delivery window and fails to meet it, that rental is credited $50 on the Account Holder’s next statement, applied automatically.
Scheduling commitments are suspended during conditions outside Merit’s control, including severe weather, road and pass closures, and landfill or transfer station closures.
6. Overages and additional charges
Weight is determined by certified scale ticket at the disposal facility, and Merit provides the ticket on request. Charges for additional tonnage, extra rental days, failed deliveries, on-site relocation, prohibited material handling and failed payments are set out on the current rate sheet provided at account setup.
A failed delivery or pickup charge applies where Merit arrives and cannot place or remove the Container because of blocked access, a locked gate, vehicles or materials in the way, or an overfilled or unsafe load. Photographs are provided.
7. Payment
Account Holders authorise Merit to charge the payment method on file for each rental on the delivery date, and for any overages or additional charges once determined. Payment methods are stored with Merit’s payment processor; Merit does not retain card numbers.
A consolidated statement listing all rentals by job address and date is emailed monthly to the billing contact. The statement is a record, not an invoice — charges are made at the time of each rental.
If a charge fails, the account is placed on hold and no further deliveries are scheduled until a valid payment method is provided. Merit may charge a failed payment fee and recover reasonable collection costs.
8. Site access and placement
The Account Holder designates the placement location and is responsible for confirming it is suitable, accessible and legally available for use.
Surface damage. Delivery and removal can crack, mark or depress driveways, aprons, curbs, sidewalks, sod, irrigation and buried utilities. Merit is not responsible for damage to any surface it is directed to drive on or place a Container on. Protection boards reduce but do not eliminate this risk. Notify Merit of septic systems, leach fields, buried lines and heated driveways before delivery.
Clearance. Delivery requires a straight approach clear of overhead power lines, tree limbs, gates and low eaves. Confirm the approach before the truck is dispatched; see our placement and access guide.
Permits. Where a Container is placed on a street, alley, right-of-way or other public property, the Account Holder is responsible for obtaining and paying for any required permit and for compliance with HOA rules. Merit will not place a Container on public property without evidence of a permit. See the permit guide.
9. Loading and prohibited materials
Material must be loaded level with the top rails. Merit will not transport an overfilled Container and will apply a failed pickup charge if asked to.
Prohibited in any Container: liquids of any kind; wet paint, stain, solvents, oil, fuel or antifreeze; chemicals, pesticides and herbicides; asbestos or asbestos-containing material; tires; batteries of any type; propane, oxygen or other pressurised cylinders; appliances containing refrigerants; medical or biohazardous waste; contaminated soil; railroad ties; ashes or any smouldering material.
Concrete, brick, block, rock, dirt and other heavy material require a dedicated load arranged in advance and are subject to separate pricing. They may not be mixed into a general debris load. See the heavy material guide and the full rental rules.
The Account Holder is responsible for the contents of the Container from delivery until removal, including material placed by third parties, and is liable for all fines, cleanup costs and special handling charges arising from prohibited material. Merit may photograph and refuse any load.
10. Care and custody
The Container remains Merit’s property at all times. The Account Holder may not move, modify, paint or transfer the Container, and is responsible for loss or damage beyond normal wear while it is on site.
11. Cancellation and rescheduling
Delivery may be cancelled or rescheduled at no charge with reasonable advance notice as set out on the current rate sheet. Later changes may incur a failed delivery charge.
12. Liability
Merit’s total liability arising from any rental is limited to the amount charged for that rental. Merit is not liable for indirect, incidental or consequential damages, including lost time, crew standby, project delay or lost profit.
The Account Holder agrees to indemnify Merit against claims arising from placement location, site conditions, container contents, permit compliance, or acts of the Account Holder’s employees, subcontractors or site visitors.
13. Term and termination
Either party may close the account at any time on written notice. Any Container on site at termination will be removed and billed at the rate in effect. Charges incurred before termination remain payable.
14. Changes and governing law
Merit may update these terms with 30 days’ written notice to the email on file. Continued ordering after that period constitutes acceptance. These terms are governed by the laws of the State of Colorado, and venue for any dispute is El Paso County, Colorado.
